Contract-offer for the provision of educational services

Individual entrepreneur Nikolayev Fedor Alexandrovich, represented by Nikolayev Fedor Alexandrovich, acting on the basis of OGRNIP 315784700061286, hereinafter referred to as the "Contractor", by this public offer offers any individual or legal entity, as well as an individual entrepreneur (hereinafter referred to as the "CUSTOMER") to conclude an Offer Agreement for the provision of educational services (hereinafter referred to as the "CONTRACT").
In accordance with paragraph 2 of Article 437 of the Civil Code of the Russian Federation (Civil Code of the Russian Federation), in case of acceptance of the conditions set out below and payment for services, the person making the acceptance of this offer becomes the CUSTOMER (in accordance with paragraph 3 of Article 438 of the Civil Code of the Russian Federation, acceptance of the offer is equivalent to concluding a contract on the terms set out in the offer). In connection with the above, carefully read the text of this Agreement, and if you do not agree with any clause of the Agreement, the CONTRACTOR offers you to refuse any actions necessary for acceptance.
Full and unconditional acceptance of this offer is the CUSTOMER's payment for the Services offered by the CONTRACTOR in any way. With respect to the Services offered by the CONTRACTOR for promotions (special offers, if any) with payment terms in installments, the full and unconditional acceptance of this offer is the CUSTOMER's payment of the first part of the amount agreed by the parties. Attention! Detailed information on the rules for conducting educational courses is specified in the Rules of Participation (Appendix 1 to this offer, following the text of the offer itself, hereinafter the Rules).
1.1. The subject of this Agreement is the provision of educational services by the CONTRACTOR (hereinafter referred to as the Course) for the CUSTOMER, subject to availability and/or compliance of the CUSTOMER with the necessary criteria for receiving the service. Depending on the chosen Course program, Services are provided by broadcasting the Course on the Internet and/or providing Course recordings. A detailed description of the Course itself can be found by the CUSTOMER in the information resources of the CONTRACTOR at the address of the Course page specified in the Rules (Appendix 1) (hereinafter referred to as the Course Page).
1.2. Under this Agreement, the CONTRACTOR provides the following services: - preparation of the Course program; - development of a calendar plan for the Course; - providing access to the Course; - consulting support; - organizational support of the Course.
1.3. The conditions, duration and venue of the Course are indicated on the Course Page, the date and time of the Course can also be communicated by the CONTRACTOR's representatives to the CUSTOMER by sending a corresponding notification to the contact e-mail and/or in a personal message on the Vkontakte social network, and/or by sending a personal message on the Instagram social network, and/or SMS messages to the contact phone number, and/or a call to the contact phone number, and/or a text message to the contact phone number in the messenger "WhatsApp" or "Telegram" of the CUSTOMER, at the same time, the CUSTOMER is obliged to independently and in advance check the receipt of the notification coming from the CONTRACTOR.
1.4. The conclusion of this Agreement by the CUSTOMER is carried out by performing the following actions (acceptance of the public offer):
1.4.1. Making an Application for a Course on the website https://space-webinar.com
/, on the Course Page and/or subdomains of the site, and/or in the official communities, in the CONTRACTOR's social networks, and/or the contract invoice, and/or in any other way.
1.4.2. Payment for participation in the Course. By paying for participation in the Course using any of the available methods (specified in clause 2.5), the CUSTOMER unconditionally agrees to the terms of this Agreement. With respect to the Services offered by the CONTRACTOR for promotions (special offers, if any) with payment terms in installments, the full and unconditional acceptance of this offer is the CUSTOMER's payment of the first part of the amount agreed by the parties, subject to payment in installments/ credit through the CONTRACTOR's partners, the full and unconditional acceptance of this offer is the CUSTOMER's signing (in including remote) installment or loan agreements with the CONTRACTOR's partner.
1.5. The cost of participation in the Course is indicated in Appendix No. 1 to this Agreement. The specified cost is included in the cost of services, information about which, among other things, is posted on the Course Page.
1.6. This Agreement is considered concluded and comes into force for the Parties from the date of payment for services by the CUSTOMER in any way. Payment is made in the amount of 100% prepayment (a different payment procedure is possible in accordance with the terms of the promotions (special offer) reflected in the relevant Annex to this Agreement, as well as in cases after additional agreement with the CONTRACTOR, or in accordance with the terms of partner banks when using borrowed funds). The date of payment is the date when funds are debited from the CUSTOMER's settlement account to the CONTRACTOR, or deposited to the CONTRACTOR's cash desk (if there is an agent, to the CONTRACTOR's agent's cash desk), or the date of transfer of funds to the CONTRACTOR's courier (if the CONTRACTOR has such an opportunity), or the date of receipt of funds to the CONTRACTOR from partner banks when used by the CUSTOMER borrowed funds.
TERMS OF PARTICIPATION IN THE COURSE
2.1. To participate in the Course, the CUSTOMER must submit a Request in the form posted on the website on the corresponding Page of the Course, by phone 8 (812) 627-14-47 or 8 (812) 603-71-51, or in other official resources and social networks of the CONTRACTOR. When making an Application, all reference information can be obtained by calling 8 (812) 627-14-47 or 8 (812) 603-71-51.
2.2. To make an Application, the CUSTOMER must provide the following data: - name; - contact e-mail or contact phone number (for communication).
2.3. The CONTRACTOR confirms receipt of the Application, assigns the Application number and issues an invoice for payment (if payment was not made by the CUSTOMER on the CONTRACTOR's websites in ways that do not require invoicing).
2.4. The CUSTOMER pays for the services under this Agreement in the amount established by the CONTRACTOR.
2.5. Payment for the CONTRACTOR's services is carried out in one of the following ways: - by depositing cash at the CONTRACTOR's cash desk (if there is an agent, at the CONTRACTOR's agent's cash desk), or by transferring funds to the CONTRACTOR's courier (if available at the CONTRACTOR); - by paying with electronic money; - by paying via payment terminals or the Internet-banking; - by payment to the CONTRACTOR's current account; - by paying with credit funds in accordance with the terms of the CONTRACTOR's partner banks; - by other means by prior agreement with the CONTRACTOR. In case of making a payment using a bank card, the CUSTOMER is recommended to use a bank card issued in the name of the CUSTOMER. In the case of a refund of the paid funds, the refund is made using the same details for which the payment was received and on the basis of a personal application of the person (in whose name the bank card was issued). When paying with credit funds in accordance with the terms of the CONTRACTOR's partner banks, the refund is made to the account of the CONTRACTOR's partner bank. Payment is not accepted if the CUSTOMER finds a violation of the payment terms established by this Agreement and the legislation of the Russian Federation.
2.6. By accepting the terms of the Offer, the CUSTOMER agrees, in accordance with the current legislation, to the processing (hereinafter PD Processing) by the CONTRACTOR of the information provided by him and (or) his personal data. The processing of personal data is carried out with the use of automation tools or without the use of such tools with personal data, including: collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data for the purpose of fulfillment by the CONTRACTOR of its obligations assumed under the terms of this Agreement, other obligations stipulated by the Agreement, and also in order to comply with the requirements of regulations on countering the legalization of criminally obtained funds and other regulations. The term of use of the personal data provided by the CUSTOMER is indefinite. The CUSTOMER also gives his consent to the processing and use by the CONTRACTOR of the information provided by him and (or) his personal data in order to carry out an informational mailing (about the CONTRACTOR's Courses) and/or an advertising mailing about the services of the CONTRACTOR and/or the CONTRACTOR's partner at the contact phone number and (or) contact email address specified by the CUSTOMER. The consent to receive the mailing list is considered to be provided indefinitely until the CONTRACTOR receives a written notification by e-mail email@example.com about the refusal to receive mailings. The CUSTOMER also gives his consent to the transfer, in order to carry out the actions provided for in this paragraph, by the CONTRACTOR of the information provided by him and (or) his personal data to third parties in the presence of a contract duly concluded between the CONTRACTOR and such third parties.
2.7. If the Customer is a commercial organization, then interest on the amount of debt for the period of use of funds for any monetary obligation of each of the Parties provided for in Article 317.1 of the Civil Code of the Russian Federation is not accrued and is not payable to the opposite Party under this Agreement.
RIGHTS AND OBLIGATIONS OF THE PARTIES
3.1. THE CONTRACTOR undertakes:
